The Partner Visa (Subclass 820/801) is an onshore visa, therefore you must be in Australia at the time of application. This particular visa requires a significant amount of evidence in order to prove that you are in “a genuine and continuing relationship” with your partner.
For most offshore visa's, there is a requirement for the applicant to be outside of Australia at the time of grant. The Department has just announced that this requirement will be waived for certain family visa applicants.
The program was introduced in order to attract highly talented individuals who are at the top of their field in high growth industries. It is a streamlined visa pathway for highly skilled professionals to work and live permanently in Australia.

For all 482 and 494 nominations lodged on or after 30th September 2020 all nominated positions must be advertised on the Governments Job Active website. This is a free online jobs website. This measure "ensures that appropriately skilled Australian citizens and permanent residents are given work opportunities before overseas workers when a business has a vacancy".
