Labour Market Testing – 482 and 494 Nominations
When an employer nominates a position for either a Temporary Skilled Shortage Visa (Subclass 482) in the Short or Medium term stream, or for an Employer Sponsored Regional Visa (Subclass 494) in the Employer Sponsored stream they will need to undergo Labour Market Testing (LMT).
Labour Market Testing is the process of advertising the nominated position in Australia. It is a way of demonstrating to the Department of Home Affairs (DoHA) that you cannot find a suitable Australian citizen or permanent resident to fill the position.
Labour Market Testing Requirements:
- For all 482 and 494 nominations lodged on or after 1 October 2020 all nominated positions must be advertised on the Governments Job Active website. This is a free online jobs website. This measure “ensures that appropriately skilled Australian citizens and permanent residents are given work opportunities before overseas workers when a business has a vacancy”.
- The position must also be advertised on two or more recruitment websites, print media on radio or on an accredited sponsor website.
- Advertising must be done within the 4 months prior to lodging immediately before lodging the application for the nomination.
These requirements are in addition to the normal labour market testing requirements.
Please note, all adverts must be live for at least 28 days and can run concurrently on the separate websites.
